FansPulse Content & Disclosure Guidelines

Version 1.1 · Operator: Sports Gold Guard LLC d/b/a FansPulse
⚠ This is a template for attorney review, not legal advice. Statutory references should be verified as current by counsel before production use.

Every piece of content you create for FansPulse must clearly disclose that you're a paid partner. This is required by the FTC Endorsement Guides (16 C.F.R. Part 255) and is a material term of your Agreement.

When you must disclose

Any time you have a material connection to FansPulse the audience wouldn't expect — commissions, retainers, free subscriptions, contest entries, gifts. A referral commission alone requires disclosure, even with no retainer.

How to disclose, by platform

Not sufficient on their own: #sp, #partner, #collab, #ambassador, "thanks FansPulse," a bio-link disclosure, or disclosure on another page.

Claims

Only make performance claims (e.g., pick accuracy, win rate) using figures FansPulse supplies in approved talking points. Never claim guaranteed outcomes or profits. No purchased followers/engagement, no fake reviews, no selective deletion of negative comments (16 C.F.R. Part 465 — civil penalties).

Virtual Gifts

Gifts are digital animations FansPulse sells and displays during a LIVE. You receive a share as an independent creator, described in the Creator Monetization and Payout Policy; the base share is 50% of the customer's pre-tax price on every channel, with published tenure tiers, a launch incentive and its cap, a seven-day pending period, a $25 weekly payout threshold, and an optional instant-payout fee. You may tell viewers, in these words or close to them: "Gifts are digital animations sold by FansPulse. I receive a share as an independent creator. Gifts are not donations and don't buy anything from me personally."

Sponsor-matched Gifts. When a sponsor matches Gift earnings during a defined period, that is sponsored content and must be disclosed as such under the FTC Endorsement Guides, using an approved disclosure snippet.

Cohost splits. When a Gift's earnings are split among cohosts, the split is agreed before the LIVE begins, shown to every participant, recorded by FansPulse, and cannot be changed after the LIVE begins.
